Staff at East of England landlord to strike for nine days over pay

"Nearly 60 workers at Freebridge Community Housing, based in King’s Lynn, were balloted by Unite the Union to take part in industrial action.

The 7,000-home landlord offered employees a 5% pay increase and a £500 non-consolidated payment, Unite claimed. The union argued that this represents a real-terms pay cut with retail price index inflation at 10.7%.

The striking workers are responsible for providing home maintenance repairs and estate services, Freebridge said.

Many of the workers, who perform roles including cleaning, are paid little more than the national minimum wage and are struggling to pay their bills, Unite said.

The nine strike days are 21, 29, 30 and 31 August and on 4, 5, 6, 7 and 8 September.

Clarion UNISON Members to vote on action to save their Pensions & stop being fired.

 

On Friday this indicative strike ballot was sent to Clarion Housing Group UNISON Members being threatened with either giving up their pensions or being fired (possibly even without being rehired). A full postal official ballot of all UNISON members in Clarion is also being planned due to an unilateral real terms pay cut imposed on everyone. 

“Dear Clarion UNISON member,

 

We are aware of the worrying correspondence Clarion have sent you regarding “Defined benefit pensions closure - next steps”.

 

It is disappointing to hear Clarion are attempting to move into a dismissal and re-engagem.ent process, but rest assured we are taking legal action on this.

 

Whilst we appreciate the unnecessary stress you are being subjected to, Clarion have agreed that all members will be entitled to trade union representation at these 121 meetings to be held via Microsoft Teams. You will not get representation from us should you not be a member as at the date of your meeting.

 

Please do not hesitate to contact us (within 48 hours receipt of your meeting invite) as members, should you require trade union representation from us or reasonable adjustments made to your meeting.

 

We are running a consultative ballot of members regarding the defined benefit pension closures, and the further industrial and legal action we are taking. Completion of this ballot can only be done visiting the link below via logging into your work Microsoft Office account. Please submit it by 5pm Monday 31 July 2023. Please contact us directly should you not be able to meet this deadline due to absence etc.

 

((.  It is also very clear that Clarion have given you misleading advice about this process in order to frighten staff into consenting. Please see the advice below from Acas (not UNISON) and you will see it is perfectly legal to challenge this act if you follow certain steps (e.g. work under protest). To be clear, resigning and claiming constructive dismissal should not be considered without expert legal advice.

“Imposing a change

If you impose a change to a contract before getting agreement you will be breaking the agreed contract ('in breach of contract').

In some circumstances, an employee's actions might count as agreeing to ('affirming') the change if:

·         they continue to work under the changed terms and conditions

·         they do not inform you that they do not agree to the change

 

However, if an employee does not agree with an imposed change, they might decide to:

·         temporarily work to the new terms and conditions, but make it clear they are challenging the change ('working under protest')

·         resign and make a claim of constructive dismissal at an employment tribunal, if they feel the change significantly breaks their agreed contract (a 'fundamental breach of contract')

If an employee works under protest

If an employee works under protest, they continue to work under the changed terms, but make it clear that they do not agree to the change and take steps to challenge it.

An employee should make it clear to you that they're working under protest. They should usually do this in writing on a regular basis, for example every time they get paid.

They should normally only work under protest for a short time so they can formally raise their concerns with you or take legal action if you do not resolve their concerns.

For example, depending on the circumstances, an employee could decide to make legal claims against the organisation for:

·         damages for breach of contract at a civil court

·         'unlawful deduction of wages' at an employment tribunal, if the change affects their pay

·         discrimination, if the change means they are treated unfairly in relation to certain 'protected characteristics' under the law

 

If you impose a change that makes an employee's terms and conditions significantly worse than before, they might be able to claim unfair dismissal while continuing to work under the changed terms. This is a very complex claim. You should get legal advice if you're in this situation.

If there's a trade union

If you impose a change after not being able to reach agreement with a recognised trade union, the trade union might consider:

·         taking industrial action – for example a strike, refusing to take part in certain activities, or a 'work to rule' where employees do no more than what they're contractually required to do

·         supporting individual employees to make claims to a court or employment tribunal

Clarion Housing Group - June Pensions and Pay update - strike ballots over breaking #pension promises and poverty pay

Dear Member,
On Thursday last week Clarion confirmed that they intend to go ahead and close the Clarion legacy defined benefit pension schemes (not the Standard Life stakeholder fund most staff are members of) and therefore wreck the futures of around 250 long serving members of staff as well as break promises made to those staff and to important external stakeholders. They are also intending to bring about these changes by “fire and rehire”.
On Friday, Clarion UNISON reps met with our full time UNISON official to decide next steps on Pensions and Pay. It was decided to organise an indicative strike ballot for all members impacted by the pension closes as well as start up a campaign to save their pensions.
A Teams meeting has been arranged for Wednesday 7 June at 1pm for UNISON members. Another open meeting for all staff impacted will be held on Friday (details will be emailed directly to affected members).
Also, the meeting on Friday indicated that Clarion are not budging over pay despite UNISON making concessions and compromising so we will be moving to hold an official postal ballot on industrial action over the pay cuts all of us are suffering from due to a significantly below inflation pay imposition (5% or £2k).
There is much to do before we can hold a legal ballot on industrial action. We have to firstly make sure that all members’ home postal addresses are correct. We also need to hold meetings with members (and non-members) explaining “what is industrial action”, “does UNISON pay strike pay” , “is my job safe if I strike” etc. We will be producing guides and FAQs.
We also need to start to escalate into an industrial action ballot by firstly starting a campaign of events while we check postal addresses and inform members about what the process is.
In the meanwhile, go to MyUNISON https://www.unison.org.uk/my-unison/ and set up your admin account with UNISON (you will need your membership number which is at the bottom of this email) and check that your postal address, email and telephone number is correct. Send us an email when you have checked this and they have the right postal address to unison@clarionhg.com
Please feel free to share this to any non-members who may be interested and encourage them to join UNISON so they can take part in the ballot. They can find further information and sign up here.

Final thought – UNISON has made it very, very clear to Clarion management that we do not want disputes with our employers, we want solutions. If Clarion wants a meaningful conversation about resolving these issues then we will talk anytime, anywhere.

Get Help with School Uniform costs - UNISON "there-for-you" fund : supporting members when it gets tough


Tonight at our UNISON London Housing Associations Branch Executive meeting, we discussed a number of key issues facing members - possible/probable strike action over pay, breaking of pension promises and trade union victimisation & bullying by a major employer of UNISON activists. 

However, we also discussed how we can get the message out to our members about the UNISON benevolent fund called "there-for-you" which is about to open its annual "get help with School Uniform costs" cash grant application process.  This is means tested. 

UNISON is I believe the only major trade union that has its own self help charity dedicated to support its members. This week I had to refer a member who is off sick due to a disability (and on reduced pay/zero) to to see if they are able to get assistance to pay their rent and avoid eviction. 

On the day only - online applications. Up to a max of £150. Net household income* of no more than £26,000/year (£2,166.67/month)   OR:   In receipt of means-tested benefits.

Please ensure you read the below information to see if you are eligible before making an application.    

School Uniform Grant 2023 eligibility:

Applicants must:   

  • Be a UNISON member   
  • Have paid at least four weeks subscriptions at the time of applying. Subscriptions must be up to date.   
  • Not have received a grant through our main applications since 01 December 2022    
  • Not have received more than £750 in total if within the first year of membership   
  • Have savings (including the total rolling balance on current accounts) below £1,000 to qualify.     
  • Be financially responsible for school aged child(ren) and receiving Child Benefit for them. By school aged we mean children aged between 4-17 years old who will be returning to school in the autumn. 

Only one application per household will be considered.   

And EITHER:   

  • you are on a low income:   
  • Net household income* of no more than £26,000/year (£2,166.67/month)   

OR:   

In receipt of means-tested benefits. This includes:   

  • Universal Credit
  • Housing Benefit
  • Child and/or Working Tax Credits
  • Pension Credit
  • Means-tested Jobseekers Allowance
  • Means-tested Employment Support Allowance
  • Income Support

 *by household income, we mean income from: salary payments, student finance payments, state retirement pension, occupational or private pensions, child maintenance.   

What can I get help with?   

We can help with a one-off grant of £50 per school aged child, up to a maximum of £150. We want to make this fund go as far as possible and help as many members as we can.  Please only apply if you are in financial difficulty. There is a limited amount in the School Uniform Grant Fund.  

What if I don’t know my membership number?   

We cannot accept applications without a membership number. This can often be found at the bottom of any emails you have received from UNISON.

"Trouble in Mill" Clarion Housing Group Pay and Pensions Disputes

 

1. Update on Pay dispute and ballot

Following the rejection of the UNISON pay claim for 2023/24 and the imposition of pay cuts by Clarion (resulting in pay being cut in real terms by somewhere between 5 to 8.2% below inflation during the worse cost of living crisis on record). UNISON are balloting members on the offer/imposition.
 
Your Clarion UNISON stewards committee unanimously recommend that members reject this "offer" and also that members consider industrial action including strike action over this issue. We have never done this before.

The ballot will be sent out on Tuesday 28 March and will last 3 weeks (due to easter holidays). There will be meetings for Unison members and all staff every day next week and beyond.
 
UNISON remains absolutely committed to dialogue and negotiation and is willing to meet up with management ASAP to try and resolve this issue and avoid a dispute.

2. Update on dispute over Defined Benefit Pensions

It is incredible that at this time Clarion have provoked another serious dispute on top of pay by trying to impose quite massive increases in pension contributions with some members facing paying a staggering 30.3% of their pay to stay in the scheme.

UNISON has obviously objected to these demands and put forward constructive counter proposals which have been ignored by Clarion who have even completely breached the written agreement on disputes between UNISON and Clarion.

UNISON Community Seminar/Conference 2023 - Day 1

 

UNISON holds an annual Seminar and Conference for members who work in our Community Service Group (Housing Associations and voluntary sector).  This year it was held in Bournemouth. Unexpectedly I stepped in to chair a workshop on pensions due to illness.  Once again I will use my twitter feed to report on the day. 

At @unisontheunion @UNISONCommVol annual conference in sunny Bournemouth. Started 9am with meeting of Service Group Executive. Now #HousingAssociation sector meeting addressed by @CityHallLabour @Semakaleng

Our speaker @Semakaleng is Chair of @LondonAssembly #Housing committee & @CityHallLabour spokesperson. I asked for appropriate support for our campaigns against pay cuts, breaking #pension promises & trade union victimisation. Sem is willing to listen & work with us

After @Semakaleng we had a roundtable feedback from Housing Associations @UNISONCommVol members from all over the UK. Common themes were Cost of Living, pay cuts (below inflation offers), breaking #pension promises, bullying, discrimination, stress, workload but some positives. I made a suggestion about a new campaign to improve Housing Association Governance and accountability.

After lunch the @UNISONCommVol annual seminar kicks off with welcome from our Chair Malcolm Gray (long lost cousin) & speech/Q &A from @unisontheunion regional secretary Clare Williams. The actual #unisoncomm23 conference starts tomorrow

Final presentation by @organiserjo the @unisonglr regional secretary on "organising & recruitment strategy development project". We need to build on our strengths. While we need to acknowledge our weakness we should not beat ourselves up. Need to learn & evaluate.

UNISON London Ambulance Service (LAS) Strike: Picket outside their Waterloo Headquarters 10.2.23

 

After work this evening I went to the UNISON picket line outside the LAS headquarters in Waterloo, Central London. I went to show solidarity and support on behalf of Greater London UNISON Regional Council officers and my own Housing Associations UNISON branch. 

It was yet another, well organised and well supported LAS picket. Congratulations to their Branch Secretary Eddie Brand, and their stewards and regional support staff including our Regional Secretary, Jo Galloway. The pickets were confident, knew what the battle was about and what to do on a picket line. 

I see also from other social media reports that some LAS pickets are tomorrow setting off as volunteers to Turkey to help out as paramedics with the dreadful recent earthquake.  Last year the branch helped organise a convoy to Ukraine to deliver much needed medical supplies and equipment. 

I have been on various picket lines in my time in the Labour Movement and the UNISON LAS are by far the best organised I have ever attended. 

Our ace UNISON Head of Health, Sara Gorton, gave short speech to the pickets thanking them for all they are doing to save our NHS.

Fellow London UNISON activists Anu Prashar and Abiola Kusoro were also there to show solidarity.

Just to point out that contrary to Tory lies and smears, for life and limb calls, pickets are volunteering with the full support of their stewards, to leave the picket line to attend, and I have witnessed this on many occasions during this strike.  Because it is an "operational" picket line, with emergency ambulances coming and going, the branch has to be careful of numbers of pickets and supporters to ensure safety. 

I came back home tonight feeling uplifted and proud of my union and our members.
